Q A GP practice has reported that some pharmacies have refused to take back waste from patients, or their representative, as some of the returned medicines from the patients home came from non-primary care settings, ie hospitals, hospices etc. Please can you advise? A The obligation for pharmacies to take back patient-returned medicines is dependent upon whether the pharmacies provide what is defined in The National Health Service (Pharmaceutical and Local Pharmaceutical Services) Regulations 2013 (the regulations} as "essential services". These services are paid for by NHS commissioning organisations on behalf of the pharmacies. Essential services include the collection of unwanted medication from patients for disposal and the receiving pharmacist has a duty to dispose of it where it has previously been kept in the patient's house, a children's home or a residential care home. Pharmacists must accept unwanted returned medicines from patients regardless of where the medicines were dispensed from.
