A coalition of vehicle and engine manufacturing groups is asking the Supreme Court to overturn a lower court ruling that found it lacked standing to challenge EPA's decision to allow up to 15 percent ethanol (El5) to be blended into gasoline - up from the longstanding E10 limit. The Engine Products Groups filed a March 25 petition for a writ of certiorari urging the justices to review an appellate ruling that found the engine manufacturers, as well as oil and food industry groups, could not challenge EPA's decision to grant partial waivers approving sale of El5 gasoline for 2001 model year and newer passenger cars and light trucks. (Doc ID: 2428910) The groups have long been concerned that EPA's decision to allow higher concentrations of the fuel, which is more corrosive than E10, will damage vehicles and their engines, and that engine warranties will be voided, leaving manufacturers on the hook for any damages.
