EPA and the Department of Justice (DOJ) are touting novel criminal sanctions against a South Carolina hog farm, including a total of $ 1.5 million in fines and a six-month prison sentence, to warn concentrated animal feeding operations (CAFOs) to seek discharge permits despite EPA's uncertain regulatory authority. "Owners and operators of concentrated animal feeding operations must comply with the nation's Clean Water Act for the protection of America's streams, wetlands and rivers," Ignacia S. Moreno, DOJ's assistant attorney general for the environment said in a Feb. 13 press release announcing the sentencing. Maureen O'Mara, special agent in charge of EPA's criminal enforcement office in Atlanta, added that the sentence "send(s) a clear message to CAFOs and their owners that if you disregard the law, you will be prosecuted."
