A little noticed but significant change to a Senate bill intended to force EPA to ban asbestos could allow industry to continue using materials capable of producing dangerous exposure levels to the known carcinogen and is prompting proponents of stricter legislation to lobby House members to adopt the Senate's original legislative language, several informed sources say. At issue is S. 742, which the full Senate unanimously approved Oct. 4. As originally introduced by Sen. Patty Murray (D-WA) March 1, the bill would have required EPA to prohibit the manufacture, distribution and importation of all asbestos containing products (ACP), which it defined as "any product (including any part) to which asbestos is deliberately or knowingly added or in which asbestos is deliberately or knowingly used in any concentration." But in a little noticed changed, the version of the bill instead requires EPA to ban asbestos containing materials (ACM). The Senate approved Toxic Substances Control Act (TSCA) defines ACM as "any material which contains more than 1 percent asbestos by weight," a concentration critics say can still product dangerous explosive levels.
