California has adopted what may be the first state law in the country requiring regulators to assess waste sites for possible exposure pathways from toxic vapors, which may pose a significant new cleanup burden on the Defense Department and other liable parties and may prompt other states to follow suit, sources say. The legislation, signed into law Oct. 13 by California Gov. Arnold Schwarzenegger (R), is believed to be the first in the nation to require such assessments for volatile organic compounds that can contaminate indoor air, sources say. Regulators in other states, including New York and New Jersey, have regularly required such assessments as a guidance or regulatory matter. Relevant documents are available on InsideEPA.com. See page 2 for details. Vapor intrusion results when chemical vapors emerge from polluted soil or groundwater and contaminate indoor air. The contamination can be caused by spilled oil and industrial chemicals and has become an emerging concern nationwide, with toxic vapors being found in residences, office buildings and industrial sites.
