EPA appears set to reject industry arguments that the agency's pending final rule regulating waste discharges from concentrated animal feeding operations (CAFOs) would unfairly impose severe penalties on feedlots that discharge but do not apply for a permit, a move that may spark litigation once the rule is finalized. EPA is preparing to finalize its long-awaited CaFO rule in the coming months, and industry sources say the agency looks likely to retain language in the proposal that would redesign the rule's so-called "duty to apply" provision that will require CAFOs that "discharge or propose to discharge" to apply for a National Pollutant Discharge Elimination System (NPDES) permit.
