The Los Angeles Department of Water and Power will avoid a lawsuit by customers who said it overcharged them for electric power and then transferred the surplus funds to the city, amounting to an illegal tax, after the Ninth Circuit affirmed dismissal of federal claims. In a would-be class action filed in 2016, the customers brought claims under the Racketeer Influenced and Corrupt Organizations Act, 42 U.S. Code Section 1983, and the Hobbs Act, which imposes criminal punishment for the taking of property by extortion.
