Colorado has agreed to revise its state implementation plan for regional haze to include more stringent nitrogen oxides emissions limits for a power plant in the northwestern part of the state (WildEarth Guardians v. Environmental Protection Agency, 10 Cir., No. 13-9520, briefing order filed 7/11/14). Under the agreement, reached July 8 in a review before the U.S. Court of Appeals for the Tenth Circuit, the Colorado Department of Public Health and Environment has agreed to revise its regional haze SIP to include a stricter nitrogen oxides best available retrofit technology emissions limit for electric generating units at the Craig Generating Station, a 1,300-megawatt coal-fired power plant.
