The U.S. Court of Appeals for the Seventh Circuit has blocked Franklin County Power of Illinois LLC from constructing a coal-fired power plant in southern Illinois because the company lacks a valid prevention of significant deterioration (PSD) permit from the Illinois Environmental Protection Agency (Sierra Club v. Franklin County Power of Illinois LLC, 7th Cir., No. 06-4045, 10/27/08). In an opinion dated Oct. 27, the appellate court affirmed an earlier finding by the U.S. District Court for the Southern District of Illinois, which held that a PSD permit issued under the Clean Air Act in 2001 to Franklin County Power and its parent company, EnviroPower LLC, had expired. The district court's decision responded to a challenge to the proposed facility brought by the Sierra Club under the citizen lawsuit provisions of the act. The district court granted summary judgment to the Sierra Club and injunctive relief halting the project.
