The Commission confirmed in Regulation EC/611/2005 (April) that the justifications for a bloc exemption to Art. 81 of the EC Treaty are still valid for liner shipping consortia. In these days of heavy discussions about the specificity of shipping and the problem of application of general European competition rules to this specific sector, this five-year extension till 2010 of the (now) expired Regulation EC/823/2000 is to be seen as assuring some form of legal certainty. The consortia Regulation EC/823/2000 basically allowed agreements and concerted practices between liner operators but subject to some specific conditions. Said operators may for instance not have a share of more than 35% of the relevant liner market and, most of all, may not covered price fixing agreements. With the new Regulation, the main philosophy has been maintained and some minor amendments were introduced. So is the right for a consortia member to withdraw from a consortium agreement after a period of notice without financial penalty extended from six month to twelve month. The possibility to prove effective price competition within the consortium, i.e. the possibility for a member to apply independent rate action to any freight rate provided for in the conference tariff, has also been enlarged by accepting to take into consideration the various individual (confidential) contracts.
