The Ohio EPA has reversed course, designating Lake Erie's open waters as "impaired" in the latest federal report on states' water quality. In a previous version of the report, Ohio had designated only Lake Erie's shorelines as impaired. U.S. EPA approved the initial report last May, prompting a lawsuit from environmental groups arguing that federal regulators had "rubber-stamped" the water quality report. They said the harmful algal blooms that annually plague Lake Erie were proof that its open waters were also impaired. EPA reversed its approval in January, telling Ohio regulators that the report wasn't "fully consistent" with federal law (Greenwire. Jan. 18). In a report released yesterday, Ohio designates the lake's open waters as impaired for recreation from algal blooms and for drinking water due to microcystin, a chemical produced by the blooms.
