Given substantial evidence that the two assertedly unexcused absences for which an LPN was apparently firedrnwere actually covered by at least one, and possibly two, FMLA certifications, a federal district court in Illinoisrnallowed her FMLA interference claim to proceed.rnLeave dates extended repeatedly. The LPN was employed by DHS at Murray Developmental Center, whichrnprovides medical and behavioral services to developmentally disabled individuals. In January 2015, she wasrninjured by a patient at Murray and her physician initially recommended that she be placed on light-duty work atrnMurray until February 6; but on that date, he would not release her to return to work for two weeks (until Februaryrn24) as a result of the injury. The LPN later submitted a Physician Statement Authorization for Disability Leavernand Return to Work (CMS-95) indicating her need to be off work, which was repeatedly extended: first untilrnMarch 9, then to March 13. On March 18, the LPN submitted another CMS-95 to Murray, which indicated shernshould be off work from March 13 to an unknown date.
