In order to ensure that employees will not hesitate to take advantage of the benefits offered them by the FLSA, the statute forbids "any person" to discharge or "in any other manner" discriminate against an employee because the employee has "filed any complaint or instituted or caused to be instituted any proceeding under or related to this Act, or has testified or is about to testify in any such proceeding, or has served or is about to serve on an industry committee" (FLSA, Sec. 15(a) (3), 29 USC 215(a) (3)). This prohibition is enforceable by injunctive measures in a government suit and by criminal penalties.
