The 1998 Digital Millennium Copyright Act (DMCA) generally provides immunity from copyright infringement for Internet service providers that comply with its mandates. However, a little-known provision of the DMCA gives a unique right to copyright holders to issue onerous subpoenas to service providers for information regarding their customers, without the need to file a lawsuit. With the spread of peer-to-peer (P2P) file-sharing networks, certain copyright holders, such as the Recording Industry Association of America (RIAA), have recently become much more aggressive in using this unique subpoena power in an attempt to track down infringers. According to one report, the US District Court for the District of Columbia alone has issued almost 2,000 such DMCA subpoenas, with the vast majority being served on broadband service providers. Even if you think that you or your client have no dog in this fight, knowing your rights and knowing how to respond to such subpoenas will be critical to protect your company from liability, as well as to maintain good customer relations.
