Adecision by the US District Court for the District of Columbia promises to clarify the ability of copyright owners to use subpoenas issued under the Digital Millennium Copyright Act (DMCA). Verizon Internet Services, Inc., would require all providers of Internet services to identify potential copyright infringers if requested under the DMCA. The case involved a subpoena that the Recording Industry Association of America (RIAA) served on Verizon Internet Services. The subpoena called for Verizon to identify a user of its Internet service who allegedly had used peer-to-peer software provided by KaZaA to offer for download more than 600 copyrighted songs. RIAA provided the user's Internet Protocol address to enable Verizon to identify of the user. After Verizon refused to comply with the subpoena, RIAA moved to enforce it. The court held that Verizon was required to comply with the subpoena. Verizon has appealed, but the decision seems likely to be upheld on appeal.
