The Regional Court of Diisseldorf denied an objection against an ex parte preliminary injunction obtained by Novartis in Germany against a generic company on the basis of SPC DE 196 75 036. The injunction was awarded on December 17, 2010 by the Regional Court of Diisseldorf. After the defendant filed an objection against the preliminary injunction, the court on March 8, 2011 confirmed its decision in view of an imminent threat of infringement of the SPC.
