The coal industry knew diverse outcomes were possible in the long-awaited 4th Circuit Court of Appeals mountaintop mining ruling. At best, we thought they might muddle it up and throw it back to Chambers (the judge who decided against the industry at the district level)."A lukewarm, "this is okay, this isn't okay" toss back to Chambers "would have been a disaster for us," the source said, because it would have resulted in further, economically punishing delays in the 404 permitting process.
