摘要

PROFESSIONAL PERSONAL FINANCIAL advisers have generally welcomed the Financial Services Reform Act, which makes more explicit what consumers should expect of them. The FSR Act simplifies and clarifies the accountability of the various parties involved in providing advice on financial products. It also sets out the responsibilities of providers of financial products to provide the actual terms, details and cost products in easily comparable way. However, the Act sets out minimum legal requirements for advice giving which are already somewhat below current good industry practice and so will be increasingly less useful for consumers to rely on. Some of the requirements of the Act also appear to be unnecessarily prescriptive for the majority of demonstrably professional and ethical planners. The Act does not define the common term "financial planning"and covers only advice on financial products, which is more limited.
