I bought an existing business seven months ago and took on all the I employees under TUPE on theirexisting terms and conditions. However, the terms of their contracts are very basic and contain no restrictive covenants. My business therefore has no protection if any of these employees want to leave and set up in competition with me, steal my clientsor poach my staff. I have just learnt on the grapevine that one former employee who came across to my business under TUPE and who left one month ago has set up in direct competition with my business and is approaching my clients and employees to go withhim. Can I vary the contracts of the staff that came to me under TUPE, adding in restrictive covenants?
