Kansas Attorney General Derek Schmidt is asking thestate Supreme Court to uphold a construction permit issuedby the Kansas Department of Health and Environment forSunflower Electric Power’s proposed 895-MW coal-fired expansion at its Holcomb station in Finney County.The legal brief filed Wednesday by Schmidt, aRepublican, was in response to a Sierra Club lawsuit thatseeks to reject the permit for the controversial $2.2 billionproject. The permit was awarded last December by KDHEActing Secretary John Mitchell after the agency’s staff foundthe Hays, Kansas-based generation and transmission co-ophad met the permitting requirements (PCT 12/17/10).
