Finney v Welsh Ministers is a Court of Appeal decision discussing the limits of the powers found under section 73 of the Town and Country Planning Act 1990 with regards to amending the description of a development. A s73 application allows planning permission to be granted for development without complying with conditions contained within the original permission. In the Finney case, the original permission was granted for the installation and operation of two wind turbines with a tip height of up to 100 metres as specified in the development description and within a condition attached to the permission, which referred to a plan with a tip height of 100 metres.
