DuPont has suffered a setback in one of the 'many ongoing lawsuits related to allegations of crop damage caused by the fungicide,Benlate (benomyl),in the early 1990s.The US Court of Appeals for the Ninth Circuit has ruled that the Hawaii District Court erred in granting a summary judgement to DuPont in a case brought by five growers in Hawaii.The Appeals Court has reversed the decision and reassigned the case to a new judge.
