摘要

In R (on the application of Samuel Smith Old Brewery (Tadcaster) and Oxton Farmv North Yorkshire County Council & Darrington Quarries Ltd a limestone quarry had been worked in the green belt. An extension was proposed and the claimants owned farmland in the area. The first claimant obtained water from an aquifer beneath the quarry to be used for brewing.The officers' report had concluded the development fell within the National Planning Policy Framework (NPPF) para.90,by which mineral extraction was not considered to be inappropriate within the green belt provided that developments preserved the openness of the green belt and did not conflict with its purposes.
