On the same day it published a final rule "clarifying the circumstances" under which an employer group or association or a professional employer organization (PEO) may sponsor a multiple employer workplace retirement plan under Title I of ERISA-expanding retirement plan access to small businesses-the Department of Labor issued a request for information (RFI) concerning "open MEPs." In a notice scheduled for publication in the Federal Register July 31, the DOL is requesting information about the definition of "employer" in Section 3(5) of ERISA.
