In its response to a no-action request to exclude a shareholder’s proposal that a software firm report on risks of omitting "gender identity" and "sexual orientation" from its employment policies, the Securities and Exchange Commission (SEC) sided with the shareholder. The Commission opined in a letter that the company must include the proposal in proxy materials for the company’s annual meeting.
