The true value of society's investment in biomedical research comes from translation into advances benefitting health and wellbeing. In the case of therapeutic, diagnostic and preventative interventions, such translation usually depends on the granting of a temporary monopoly, through patent rights, to secure a period of commercial exclusivity justifying the risk of investment. Consequently, debate arises about freedom of research activities and their purported inhibition due to intellectual property(IP) rights protection. This article argues there is a lack of evidence that IP protection measures have a significant negative impact on academic biomedical research. This perspective is developed from the experience over the last ten years of a majorAustralian medical research institute, as well as the practical experience of the author, who has worked actively in senior international positions at the academic and commercial biomedical research interface since 1978.
