Affymetrix(Santa Clara,CA),the market leader in high-density microarrays,has won an important victory in its patent case against rival,lllumina Inc(San Diego,CA).A US district court found that lllumina infringed five patents relating to a wide range of products including scanners,arrays,and software.While the court rejected Affymetrix' demand for lost earnings,the company was awarded 16.7 million in damages,higher than expected and representing a 15% royalty rate on the 111 million sales lllumina was found to have made from the disputed products between 2002 and 2005.
