On June 1, 2004, the Provisions on Administration of Foreign Investment in International Maritime Transportation (hereinafter referred to as the Provisions) of the People's Republic of China (hereinafter referred to as the PRC) will come into force. The Provisions were jointly promulgated by the Ministry of Communications and the Ministry of Commerce on March 2, 2004 as the Decree No. 1 of the year. Together with the Regulations of the People's Republic of China on International Maritime Transportation (promulgated on December 11, 2001 by the State Council and effective as of January 1, 2002, hereinafter referred to as the Regulations), the Implementation Rules of the Regulations of the People's Republic of China on International Maritime Transportation (promulgated on December 25, 2002 by the Ministry of Communications and effective as of March 1, 2003, hereinafter referred to as the Implementation Rules) and the Provisional Measures on Administration of Examination and Approval of Wholly Foreign-owned Shipping Companies (promulgated on January 28, 2000 and effective as of the same day, hereinafter referred to as the Provisional Measures), the Provisions have contributed to the formulation of a relatively complete legal framework of the PRC on foreign investment in international maritime transportation.
