When Randolph Coleman died, he owned three tracts of land in Crockett County. The tracts are included in a unit operated by Occidental Petroleum (Oxy) which is also the lessee of Randolph Coleman. In his will Randolph bequeaths to his wife Betty, a life estate in his mineral interests. After Randolph's death, Oxy drills additional wells and pays the royalties from all producing wells to Betty. The remaindermen then file this declaratory judgment arguing that Betty is not entitled to the royalties from the wells drilled after Randolph's death. The trial court grants Betty's counterclaim that would state that she is entitled to all such royalties. Held: affirmed. In construing the terms of a will, the court is attempting to determine the intent of the testator looking at the entire will and limiting its decision to the four corners of the will. There is language in the will that describes Betty's life estate as covering the minerals where "Oxy is presently making payments to me . . .." The court finds mat the language unambiguously grants Betty a life estate in the three tracts of land without limitation to the wells in existence at the time of Randolph's death.
