The European Commission overstepped its powers when it exempted the brominated flame retardant deca-brominated diphenyl ether (decaBDE) from a ban under the directive on the restriction of hazardous substances in electrical and electronic equipment (RoHS), the European Court of Justice (ECJ) ruled last week. In a judgment made public April 1, and welcomed by environmental groups, the ECJ has decided to overturn the 2005 decision by the commission to grant an exemption for deca-BDE.
