围绕农业部2017年组织的生猪屠宰行政处罚案卷评查,河南省动物卫生监督所精心组织,推选了许昌、鹤壁、周口等地的6份屠宰类案卷参评.本文结合在案卷评查中发现的事实不清、程序违法、罚缴未分离等问题以及执法过程中存在的注水查处难、技术支撑弱和罚没物品处理无依据等执法难点,提出了健全相关法律法规,完善部门间协作机制,出台相应货值认定规范等对策,以期为畜禽屠宰执法工作提供参考.%In 2017,examination and evaluation of administrative punishment files of pig slaughtering were organized by the Ministry of Agriculture. Based on careful organization,6 files derived from Xuchang,Hebi,Zhoukou and other cities were selected by Henan Animal Health Supervision Institution to take part in the national examination and evaluation campaign. During the examination and evaluation process,some problems were found,such as some facts were not clear,investigation procedures were illegal and the penalty wasn't separated from payment. Also, there were some difficulties existing in law enforcement process,including difficulty in investigating water-injected meat,weakness in technological support and poor basis in giving punishment and confiscating goods. At last, in order to provide reference for law enforcement of livestock and poultry slaughtering,some suggestions were put forward:improving related laws and regulations,perfecting the coordination system between departments,as well as formulating specifications to ascertain the value of goods.
