At present, the basic framework of the compensation system for nuclear damage has been initially formed in China. But the authority and rules of entity specification for nuclear damage compensation are poor and the procedure specification lacks. It can't adapt to the needs of nuclear development. In order to correct these defects, we suggest that: (ⅰ) the legislation should be diversified; (ⅱ) the scope of compensation for nuclear damage must be defined scientifically; (ⅲ) the compensation system must be improved by increasing the amount of compensation, implementing compulsory insurance and perfecting the system national compensation; and (ⅳ) the procedure of compensation system for nuclear damage should be repaired by remedy, jurisdiction and limitation of action.%目前我国关于核损害赔偿制度的基本框架已初步形成,但核损害赔偿实体规范权威性差、规则性弱,程序规范阙如,难以满足日益发展的核事业之需要.要修正这些缺陷,须选择多元的核损害赔偿立法模式,科学界定核损害赔偿范围,提高损害责任限额、落实强制责任险及完善国家补偿机制以健全核损害赔偿责任机制; 畅通救济途径、明确诉讼管辖及延长诉讼时效以完善核损害赔偿的程序.
