摘要

When the US Supreme Court decided Chimel v. California in 1969, it was perceived as a means of restraining the police power in this country and of strengthening Fourth Amendment rights. However, subsequent decisions made by both the Supreme Court and lower federal courts have changed this so that, currently, the 'search incident to an arrest doctrine' now enhances the power of law enforcement agents.
