As EPA increases its enforcement focus on wet weather issues, an environmental law expert says the agency could increase its use of criminal enforcement penalties to address stormwater requirements — a move that will likely garner strong industry opposition. Jane Barrett, director of the University of Maryland's Environmental Law Clinic, says EPA criminal enforcement of Clean Water Act (CWA) stormwater requirements may become an agency priority in the next few years. The comments come as EPA Oct. 12 issued its long-awaited enforcement priorities for FY2008-2010, which gives stormwater and other wet weather issues top priority. The priorities are available on InsideEPA.com. Seepage 2 for details. Barrett, a former federal and state prosecutor litigating environmental crimes cases, says the agency frequently turns to criminal enforcement after first focusing on civil penalties, which the agency has already started to use in stormwater cases.
