Rear Admiral Carter's case study is not necessarily an easy one. Deciding whether to spare lives can be a tough challenge, particularly when the decision can have an impact on mission success. Before engaging in a moral consideration about this particular case, it seems worth clarifying a point regarding legality and morality. One should attempt to separate the legal and the moral issues, even though the two are often intertwined as the bulk of the law of armed conflicts rests on moral concerns. In this case it is important to keep in mind that avoiding 'incidental loss of civilian life' is arguably a legal concern and requirement in the first place.1 Morally speaking, avoiding the killing of innocents is not always the only option. As we will see, this case could be seen as problematic, as long as we do not have full information available about the overall consequences of the decision made by the team not to bomb the bridge.
