As the EEOC and the Department of Justice continue on a collision course over the scope of Title VII’s prohibition against discrimination "because of ... sex," DOJ attorneys have filed a brief in the Supreme Court (which purports to represent the EEOC) urging the Justices to reverse a Sixth Circuit ruling that found Title VII protects a transgender funeral home employee, and others, from employment discrimination because of their failure to conform to sex stereotypes or because of their transgender and transitioning status.
