An employee requests FMLA leave for migraine headaches. But she fails to produce what you consider proper documentation, and you refuse the leave. Then the unexpected happens: Her supervisor says you're wrong, and threatens to go over your head to prove it. What do you do? Have the supervisor disciplined for insubordination? You'd better not, at least according to the federal court that heard a recent FMLA case resembling this scenario. That looked suspicious to the court. The employer eventually won the case on other grounds. But the court stressed that the supervisor had engaged in activity protected by the FMLA, even though he wasn't the one seeking the leave.
